On Wednesday 8-19-09 I requested a copy of the Department of Education form SFPD 4.03 School Site Certification signed by the Local Educational Agency Representative for the new Krystal school off of Ranchero. It's a 1 page form that is required by the State of California that states that the HUSD has done its required homework on the site. It is Certification that:
The proposed site is suitable for educational purposes and is free, or will be free prior to occupancy, from hazards that could be considered harmful to student and staff health and safety. The local educational agency (LEA) has complied with and will comply with all applicable laws and policies associated with the acquisition of the school site, including commitments for Department of Toxic Substances Control (DTSC) required activities and the following:
Education Code Sections:
17211 LEA governing board public hearing for the evaluation of the site based on the selection standards established by the California Department of Education (CDE) pursuant to Education Code Section 17251(b)
17212, 17212.5 Investigation of prospective school site; inclusion of geological and engineering studies
17213 LEA governing board-adopted determinations and findings for waste disposal; hazardous substance release; pipelines on-site; hazardous air emitters/material handlers within 1/4 mile; and air emissions from busy freeways/traffic corridors within 500 feet
17210, 17213.1, Phase I Environmental Site Assessment; Preliminary Endangerment Assessment; Response Action 17213.2, 17268
17215 California Department of Transportation review of proposed site within two nautical miles (12,152 feet) of an airport runway or airport master planned runway, and LEA governing board public hearing if report favors the site
17215.5 LEA governing board-adopted findings for acquisition of sites designated in the local government general plan for agricultural use and zoned for agricultural production

21151.2 Notice to city/county planning commission of proposed site acquisition
21151.8 LEA or other lead agency adopted Final Environmental Impact Report (EIR) or Initial Study/Negative Declaration containing determinations and findings for waste disposal; hazardous substance release; pipelines on-site; hazardous air emitters/material handlers within 1/4 mile; and air emissions from busy freeways/traffic corridors within 500 feet
21152, 21157.1, Draft CEQA document submitted to the State Clearinghouse; CEQA process completed and Notice of Determination filed with the County CEQA Guidelines Clerk for a Negative Declaration or EIR by the LEA; or project was fully covered within a previously approved EIR by another lead agency 15205 with appropriate LEA additional findings as necessary
State Policies and Regulations:
State policies regarding location of the school site relative to high voltage power transmission lines, high-pressure gas lines, railroad tracks and special site conditions noted on the SFPD 4.0, Initial School Site Evaluation have been followed. State laws and policies regarding Environmental Assessment for toxic contamination have been followed.
To the best of my knowledge, the above is true and correct. If a different CEQA process is pursued subsequent to this certification, the LEA shall immediately notify CDE and the Office of Public School Construction.
